Do I Need Brakes on My Trailer? NZ Trailer Brake Rules Explained
Does my trailer need brakes? We get asked this constantly, usually by someone standing at the counter who has just bought a trailer and isn't sure what they're allowed to tow with it.
The answer comes down to one number: what the trailer weighs fully loaded. Not the size of it, and not what you're towing it with.
First, the three types of brake
The rules use three terms and they mean quite different things.
- Service brake. The trailer's main brake, the one that slows it down as you drive alongside your tow vehicle's brakes. This is what people mean when they say "trailer brakes". It has to act on each wheel of at least one axle, and the whole combination has to pull up within 7 metres from 30km/h.
- Parking brake. Holds the trailer once it's parked or unhitched, same job as the handbrake in your car. It has to act on at least one complete axle, and either stop the trailer within 18 metres from 30km/h or hold it on a 1-in-5 slope.
- Breakaway brake. Emergency only. If the trailer comes off the tow vehicle, it applies the trailer's brakes off its own battery so the thing stops instead of running loose.
The weight thresholds
Everything hangs off gross laden weight: the trailer plus whatever you've put on it. Read the bands carefully, because a trailer sitting at exactly 2,500kg falls in the top one, not the middle.

Safety chains and breakaway brakes
These are alternatives to each other, which catches a lot of people out. The rule wants an adequately rated coupling with safety chains, or a breakaway brake. You don't necessarily need both.
Most trailers on our roads sit in the lightest band and need one chain. Over 2,000kg it's two, and the rule is fussy about them: they have to meet Australian Design Rule 62, and they have to cross each other when connected. Crossed chains cradle the drawbar if the coupling lets go instead of letting it dig into the road.
Check your shackles while you're down there. Rated shackles only. Hardware store shackles aren't up to it and they're a common weak point.
Laden weight isn't tare weight
This one catches people out regularly. A tandem box trailer might weigh 600kg empty but be rated to 2,500kg laden. It's the rating, and what you actually load on, that sets your obligations. How heavy it feels when it's empty has nothing to do with it.
Your trailer's plate, usually riveted to the drawbar or chassis, shows the rated capacity. If it's missing or you can't read it, sort that before your next WoF.
Override brakes or electric brakes?
If your trailer needs a service brake, there are two common ways to do it here.
Override (surge) brakes are self-contained, and they're what the rules call an indirect system. As you slow, the trailer's momentum pushes it up against the coupling and that movement applies the brakes, either mechanically or hydraulically. Nothing to wire into the tow vehicle, which is why they're so common on boat and utility trailers.
Electric brakes are a direct system. A controller applies the trailer brakes in proportion to how hard the tow vehicle is braking. You get finer control, you can dial the braking effort up or down, and they behave better on a long descent. That used to mean a controller hard-wired into the dash, but Bluetooth units like Elecbrakes mount on the trailer and run off your phone, so nothing gets permanently fitted to the vehicle and you can tow with a different ute without rewiring anything.
Coupling ratings: why 2,500kg is the line
This is the bit that causes the most argument at the counter, so here's the exact wording.
A trailer over 2,000kg has to have a coupling system that has a manufacturer's load rating equal to or greater than the laden weight of the trailer. That's the legal test, straight out of the rule. Your coupling's rating isn't a recommendation.
Standard hydraulic override couplings sold in New Zealand top out at 2,500kg. That's a limit of the hardware, not a rule about override braking in general. And watch the boundary: at exactly 2,500kg laden you're already in the top band, so an indirect brake has to meet UN/ECE Reg 13.
At 2,500kg and up you've got two options, and most people only know about the first one.
1. A 3,500kg coupling with electric brakes
A coupling body rated to 3,500kg, electric brakes on the axles, and a controller. Worth knowing that this style of coupling doesn't brake anything itself. It's rated for the weight, and the electric brakes do the work.
2. An ECER13 certified override system, no electrics at all
An indirect system certified to UN/ECE Reg 13 is allowed right up to 3,500kg. Here that generally means a Knott system, where the coupling and the mechanical drum brakes are certified together as a matched set.

Why you'll hear conflicting advice on this
Because the rule changed. The Light-vehicle Brakes Amendment 2019 came into force on 1 June 2019, and the whole point of it was to let trailers between 2,500kg and 3,500kg run indirect service brakes as well as direct ones. Before that you couldn't really do it without an exemption.
So if someone tells you override braking is banned over 2,500kg, they're working off what was true up until 2019. What hasn't changed is the practical bit: if your trailer is rated at 2,500kg or more and you've got an ordinary hydraulic override coupling on it, that coupling isn't rated for the job.
Keeping a braked trailer legal
Brakes only count if they work. What usually fails a trailer at WoF time is seized calipers, scored or badly corroded discs, pads that are thin or oil-contaminated, perished hydraulic hoses, and breakaway batteries that won't hold charge. Boat trailers are the worst of them, for obvious reasons.
If you're giving yours a once-over, check pad thickness is even side to side, the caliper slides freely, there's nothing weeping at the hose ends, and the override coupling feels firm when you compress it.
